No knives in Philly; guns are OK, though...

Post by TEKTITE » 02 Apr 2009, 05:12

Philadelphia, City of Brotherly Love- You can carry your gun, but don't let them catch you with a pocketknife...

From the The Philadelphia Code

§ 10-820. Cutting Weapons in Public Places. 189

(1) Definition.

Cutting Weapon. Any knife or other cutting instrument which can be used as a weapon that has a cutting edge similar to that of a knife. No tool or instrument commonly or ordinarily used in a trade, profession or calling shall be considered a cutting weapon while actually being used in the active exercise of that trade, profession or calling.

(2) Prohibited Conduct. No person shall use or possess any cutting weapon upon the public streets or upon any public property at any time.

(3) Penalty. The penalty for violation of this Section shall be a fine of not less than
three hundred (300) dollars and imprisonment of not less than ninety days.

Insane.

No tool or instrument commonly or ordinarily used in a trade, profession or calling shall be considered a cutting weapon while actually being used in the active exercise of that trade, profession or calling.
And how is one to transport said trade/profession/calling tools?

Remember the kid that got reamed because school parking lot security saw a box cutter from his after-school job in his car?
The cost of fighting a charge will be prohibitively expensive.

:(

is the fine compounded if you tell an insensitive joke while in possession of an evil bladed cutting weapon?

On the side.....the bosses partner noticed my pocket knife in a meeting and asked the bossman "do all your reps carry weapons?"
I showed him the 'print' of the BE .40 and did my best Crocodile Dundee "That's not a weapon. THAT"S a weapon"
That was the end of discussion too.

Ah but the 'pointy' knives are unnecessary. Just a slightly serrated yet dull edge and rounded nose is all thats needed .....

All the Brit doctors and chefs say so ;)

Yeah, but notice they only say "cutting edge" in Phila.. I guess that means the gangbangers can still carry screwdrivers for muggings. :guns:

They'll eliminate the "stabbings" in the UK, then when "slashings" are the leading cause of *whatever*, the cutting edge is next. Gotta' admire Philly; they went right to the edge... :rules:

Would the jawbone of an ass be an edged weapon? :ponder:

edit: they better get on this one> Judges 15:15

And he found a new jawbone of an ass, and put forth his hand, and took it, and slew a thousand men therewith.

Quote from another forum on a possibie scenario (sharp tongue-in-cheek). Just imagine:

"Philly Cop: "Hey, that's a nice 50 Cal. Desert Eagle riding on your hip."
Philly Citizen: "Thanks."
Philly Cop: "...and two spare mags... cool. Well, have a nice... wait a second... is that a miniature Swiss Army knife on your key chain?"
Philly Citizen: "Sure is."
Philly Cop: "I'm gonna have to cite you for that. Let's see some ID."
Philly Citizen: "But... I have a valid LTCF."
Philly Cop: "Not for the pistol, for the KNIFE! Those knives are dangerous weapons! They're illegal!!" "

I wonder? If I sharpen the edge of the belt clip on my Kel-Tec, would that make my gun illegal? :ponder:

Philly has great cops and idiot politicians. While it is absurd, no cop will enforce it unless the thing is being used in a crime.

Sometimes there are those badge heavy pricks who will look for any excuse to pinch someone.
I've even seen some of my co-workers make arrests for riding a bicycle on a sidewalk...
Case in point, True story- California: A friend was riding his Segway, and was stopped. Arrested for carrying a Spyderco knockoff. Convicted of carring a "switchbalde or gravity knife" because the arresting officer was able to flick open the knife with one hand; a felony conviction.

MO. obviously you're correct. We've seen guys who never should be on the job. I just figure that type would already be able to find a law to abuse. You know me, though. I always look to give LE the best light.

TK you can be proud of your dad. He probably was during the era I was a trooper in PA. Jersey had a reputation as having the toughest troopers in the country. We'd meet them for breakfast, and they were almost all marines fresh back from Nam.

I carry a knife always! To church, to school, to boy scout meetings, it doesn't matter. I only leave it in the car or home if I plan to go through a metal detector at the courthouse or airport. And I'm not talking about a miniature swiss army knife.

We the people need to knock these dumbass politicians off their pedestal. Who the f*$k do they think they are? They work for us. We are the boss of them, not the other way around.

This really bugs me. Next will be pointy scissors and toenail clippers if they have a "fixed or attached pointed file." This is kindergarten mentality here. If Billy chews gum in class, the whole class stays in for recess.

I don't appreciate having my rights attacked when I have never done anything wrong. I don't have a problem with sentencing a bad person who actually cut somebody maliciously to the maximum sentence allowed by law. Hmmm, there's a novel idea :ponder:

It gets better...I was talking with a Boy Scout leader last night. It seems that the BSA has had to grant an exception to Troops in Philly.

For those of you who were not in Scouting; When you have a formal inspection, the manual requires you have your scout knife attached to your belt (Be Prepared) as part of your uniform. Troops in Phiadelphia had to have this requirement waived, since all knives are illegal in public, and scouts usually meet on public property (schools, community ctrs., etc.), march in parades, perform community service, help little old ladies across the street, and, apparently, are a major threat to the public safety with those 3" pocket knives.

Too late!
"Any knife or other cutting instrument which can be used as a weapon

According to the TSA (a Federal agency, after all, and therefore a presumed authority :gavel: ) scissors would be included in the above.

"other cutting instrument" - steak & kitchen knives, shaving razors, boxcutters, wood chisels, antique chipped-stone arrowheads, or anything else some idiot prosecutor may care to envision, and a judge would agree with.

This sort of reminds me of North Carolina's "Weapons of Mass Destruction" legislation which includes silencers under that definition.

At my sister-in-laws B-day party a couple weeks back, her little sister's drooling mate pointed at my back pocket and asked:
"i da kny lea huh?" ( he's from the northeast AND a boxer)

translation: Is that knife legal here? (I also speak and understand Boomhauer)

It struck me then how frikkin stupid these laws are. It never crossed my mind to consider the legality of carrying a common tool.

I live in philly and carry my pocket folder (and my Ruger LCP) everywhere, pretty much in plain sight, as the pocket clip and top of the knife are clearly visible in my front jeans pocket. I am sure that in the time i've carried it many dozens of cops have noticed it on my person. None have ever said anything to me.

Is this actually a law yet, or is it up for consideration? Some of the things politicians do is beyond comprehension. I must use my pocket folder 10x a week if not more for every day practical tasks.

Insane.
